Madison’s Tough New THC Rules Come as Federal Crackdown Looms

Just as hemp-derived THC businesses in Madison reel from a federal ban taking effect in November 2026, the City Council is poised to approve even more restrictive local rules at the next council meeting November 25th. These include raising the purchase age to 21, requiring THC-infused drinks to be sold from coolers rather than on the floor, and banning new dispensaries within 0.25 miles of schools and parks.
The reaction? Push back from legalization supporters, who argue the city is punishing adult consumers and would-be small business owners — especially coming at a moment when the entire hemp-THC industry is under existential threat from the feds.
On top of that, Dane County recently passed a 21+ rule for hemp-THC sales, with fines up to $1,000 if retailers violate it. Critics warn that these local crackdowns worsen the picture for an industry already being squeezed federally.
What makes this even more frustrating to reformers is that cannabis possession in Madison has been decriminalized for decades — under local ordinance, small amounts only warrant a low or no fine. Now, with new rules tightening around THC, many worry: is Madison reversing direction on the very decriminalization it once championed? And if the city rolls back tolerance, which other communities might follow?
Among the voices in the fight, Melissa Agard, now Dane County Executive and former state senator, stands out. WiscoCAN previously honored her with a cannabis reform award for her advocacy. When she accepted, we also pressed for a stronger codification of the $1 fine system — something that now, in the face of new restrictions, may look more fragile than ever.
